Introduction

I. Overview of the Reservation System

India's reservation system is a constitutional affirmative action policy aimed at addressing historical caste-based discrimination. It reserves seats in government jobs, educational institutions, and legislatures for Scheduled Castes (SCs), Scheduled Tribes (STs), and Other Backward Classes (OBCs). The system has been extended over time, notably through the Mandal Commission's recommendations in 1990, which introduced a 27% reservation for OBCs, and the 103rd Constitutional Amendment in 2019, which added a 10% reservation for Economically Weaker Sections (EWS) in the general category.

II. Limitations and Criticisms

Despite its intent, the caste-based reservation system faces several criticisms:

• Economic Disparities: Caste does not uniformly correlate with economic disadvantage; many economically disadvantaged individuals are excluded from reservations due to their caste.

National surveys, such as the National Family Health Survey (NFHS-5) and the Socio-Economic and Caste Census (SECC), reveal significant disparities in educational attainment and income between rural and urban areas, as well as within different caste groups. For instance, a substantial proportion of rural households, including those from SC and ST communities, have a monthly income of less than ?5,000, indicating that socio-economic backwardness encompasses more than just caste.

V. Implementation Challenges

Implementing a multi-factor reservation system presents several challenges:

• Determining Weightage: Assigning appropriate weightage to each socio-economic indicator requires careful consideration and empirical analysis.

• Political Resistance: Reforming the existing reservation system may face political opposition from groups who perceive a loss of benefits or influence.

VI. Legal Considerations

The legal viability of a multi-factor point-based reservation system hinges on its alignment with the Indian Constitution, particularly Articles 15 and 16, and the interpretations provided by the Supreme Court. While the Constitution has recognized economic backwardness as a valid criterion for reservation, any new model must adhere to the 50% cap on reservations established in the Indra Sawhney case and ensure that it does not violate the principles of equality and non-discrimination.

To facilitate this transition, the following recommendations are proposed: 1) Phased Implementation: Initiate a phased implementation of a multi-factor point-based model, beginning with pilot programs in select educational institutions and government sectors. This will allow for testing and refinement of the model before widespread adoption. 2) Data-Driven Indicator Selection and Weightage: Conduct rigorous data analysis using surveys like NFHS and SECC, along with other relevant socio-economic indicators, to determine the most appropriate factors and their respective weightage in the point system. Ensure that the chosen indicators accurately reflect the various dimensions of disadvantage. 3) Independent Verification and Grievance Redressal: Establish independent bodies with the necessary expertise and resources for the reliable verification of socio-economic data. Simultaneously, create accessible grievance redressal mechanisms to address any disputes or concerns regarding the application of the multi-factor model. 4) Stakeholder Engagement and Public Awareness: Launch comprehensive public awareness campaigns to educate all stakeholders, including various caste groups, policymakers, and the general public, about the rationale and potential benefits of the proposed reforms. Engage in open and transparent consultations to build consensus and address concerns. 5) Regular Review and Evaluation: Implement a robust system for the regular review and evaluation of the multi-factor model\'s effectiveness in achieving its objectives, addressing unintended consequences, and adapting to evolving societal needs. By adopting a gradual, data-driven, and inclusive approach, India can strive towards a reservation framework that is more effective in addressing the multifaceted realities of socio-economic disadvantage while upholding the constitutional ideals of social justice and equality for all its citizens.
